UPDATE: The next De Anza Cove resident meeting is scheduled for February 9 at 7:00 p.m. at the Bay Club clubhouse.

The De Anza Cove vs. City of San Diego class action case (S.D. Sup. Ct. Case No. GIC 821191) has been in litigation since November 2003. As everyone has been aware, after trial in 2008, Judge Hayes ordered a Tenant Impact Report to be prepared. At a status conference held on January 25, 2012, representatives of Overland Pacific & Cutler, the company commissioned to do the Tenant Impact Report, delivered to the Court an initial draft of the long-awaited Tenant Impact Report which will now get reviewed by both sides.

At the hearing, the Court appointed the Hon. Leo S. Papas (Ret.) as a Special Master to assess the sufficiency of the Impact Report and provide rulings and recommendations to the Court to ensure that the Impact Report complies with the law. Judge Papas, a retired Federal Magistrate Judge, is familiar with De Anza, having successfully mediated the abuse claims in 2009. We anticipate at least a few meetings and hearings with Judge Papas and the City to hash out disputed aspects of the report, but we are hopeful that a final draft will be ready in the coming months.

Once the report is finalized, then Judge Hayes will make a final determination of the monetary value the City owes to the De Anza class members. None of the initial draft copies will be released to the public because the report will likely be subject to substantial revisions. But final versions will be circulated for all to see.
